This Terms & Conditions (“Terms”) agreement governs your use of KnotFalse.com (Pty) Ltd (“KnotFalse,” “we,” “us,” or “our”) and applies to all visitors, customers, and users of our IT services, software development, domain hosting, and cloud services.

Subsidiary Clause:

• KnotFalse is a holdings company that owns, launches, and may sell subsidiaries.
• Each subsidiary operates as a separate legal entity with its own Terms & Conditions and Privacy Policy.
• If a subsidiary is added, removed, or sold, these Terms remain applicable without modification to KnotFalse.

By using https://knotfalse.com (“Website”) or any KnotFalse services, you agree to these Terms. If you do not agree, please do not use our services.

• App Development (iOS & Android apps hosted on App Store & Google Play)
• Web & Domain Hosting (Including domain registration & management)
• Cloud & Data Hosting (AWS-based cloud storage solutions)
• IT Consulting & Business Automation

Subsidiary Services:

• Some services are provided through subsidiaries under their own legal agreements.
• Users engaging with a subsidiary’s services are subject to that subsidiary’s Terms & Conditions.

3. User Responsibilities

By using our services, you agree to:

• Provide accurate and up-to-date information when registering.
• Not misuse our services for illegal or malicious activities.
• Not attempt to hack, disrupt, or exploit vulnerabilities in our software, hosting, or servers.
• Comply with all applicable laws (South African & international).
• Maintain the security of your login credentials and report unauthorised access.

Failure to comply may result in account termination or legal action.

4. Payment, Subscriptions & Refund Policy

4.1. Payments & Billing

Payments for our services (hosting, software development, domain management) are processed via:

• PayFast, PayPal, Stripe, Paddle, or EFT (Electronic Funds Transfer)
• Monthly or annual subscription plans for hosting & SaaS services

All billing is in ZAR (South African Rand) unless otherwise stated.

4.2. Refund Policy

Non-Refundable Services:

• Domain registrations & renewals
• Custom software development fees
• App development costs

Refunds may be issued only for hosting or SaaS subscriptions if a cancellation request is submitted within 7 days of payment.

5. Intellectual Property

All content, software, and services offered by KnotFalse are protected under copyright & intellectual property laws.

• You may not copy, modify, or distribute our software or proprietary content without prior written permission.
• Any custom software developed for clients remains KnotFalse’s intellectual property unless specified otherwise in a contract.
• Trademarks, logos, and branding associated with KnotFalse cannot be used without prior consent.

Unauthorized use of our intellectual property may lead to legal action.

6. Privacy & Data Protection

• Our use of personal data is governed by our Privacy Policy.
• By using our services, you consent to data collection for service functionality & security monitoring.
• If you interact with us via social media, lead forms, or WhatsApp, we may process limited personal information.

We do NOT sell or share your data with third parties for advertising purposes.

7. Subsidiary & Business Transfers Clause

Subsidiary Operations & Changes

• KnotFalse reserves the right to add, modify, or sell subsidiaries at any time.
• Users engaging with subsidiaries agree to separate legal agreements for those entities.
• KnotFalse does not automatically inherit legal liability for a subsidiary’s independent operations.

If a subsidiary is sold, user data associated with that subsidiary may be transferred, but users will be notified.

8. Service Availability & Modifications

• We strive to provide 99.9% uptime for hosting & cloud services.
• However, we may need to suspend services temporarily for:
• System maintenance & security updates
• Unforeseen downtime or emergency situations

We are NOT liable for disruptions beyond our control (e.g., AWS server failures, cyberattacks, etc.).

9. Limitation of Liability

KnotFalse.com (Pty) Ltd is NOT responsible for:

• Loss of data due to user errors, third-party service failures, or cyberattacks
• Financial losses or lost business opportunities resulting from downtime or software bugs
• Unauthorized access due to weak passwords or insecure user practices

Our total liability is limited to the amount paid for the affected service in the last 6 months.

10. Account Termination & Suspension

We may suspend or terminate your account if:

• You violate these Terms & Conditions
• You fail to make timely payments for subscription-based services
• You engage in fraudulent, illegal, or harmful activities

You may terminate your account at any time by contacting support@knotfalse.com.

Upon termination, your access to KnotFalse services will be revoked.

11. Governing Law & Dispute Resolution

• These Terms are governed by South African law (POPIA, CPA).
• Any disputes shall first be resolved through mediation.
• If mediation fails, disputes shall be resolved in South African courts.

International clients agree to comply with South African laws when using our services.

12. Changes to These Terms

We may update these Terms periodically.

• Changes will be posted on our website.
• If changes impact your rights, we will notify you via email or platform notifications.
• Continued use of our services after changes take effect means you accept the new Terms.
